Commencement of deed transactions and transactions that will be continued;
Within the scope of Alanya Sönmez Real Estate and Construction Company, relative sales representative, who provides service for you, will go to title deed follow-up office with the documents, which are provided by you for title deed transactions and deliver the documents in full required to start procedures without any problem.
Afterwards, our title deed follow-up office will maintain the following transactions in the grip of personnel of Alanya Sönmez Real Estate and Construction Company. At the title deed registration office, transactions can be started by title deed follow-up form and other documents, which are provided by you. At first, Manager or Assistant Manager of Title Deed Registration Office carries out transfer procedures. The Manager or Assistant Manager of Title Deed Registration Office checks your documents and then transfer you to the most available Title Deed Registrar. Your transferred documents are delivered to relative title deed registrar. It will be started to enter your documents into system after title deed registrar controls them. Entering information into the system will be completed between 14.00 and 16.00 within the working hours. This can take more than a day. If the other procedures predicted by Title Deed Registration Office are completed, system will give circulating capital and payment accruals belonging to the deed which has been prepared for the procedures. In order that these accruals can be paid, accruals are delivered to one of the cash points of authorized bank (Ziraat Bank, Halk Bank and Vakıf Bank) by our deed follower and then paid accruals are taken. These paid accruals given by the bank, are delivered to the relative title deed registrar immediately again. Relative title deed registrar enters these accruals into the system in accordance with the laws of the title deed registration office. Manager or assistant manager of title deed registration office will make the last control to conclude the sales procedure. Manager or assistant manager of title deed registration office who analyzes whole procedures prepared by title deed registrar will sign the sections which should be signed and then authorize title deed registrar to finish the procedure. Title deed registrar invites purchaser and seller to the office so that they sign the documents which have been controlled finally and are ready for title deed transfer. You will put signature to the required sections in order to complete procedures and finish the sales procedure. After signing and finishing sales procedures, title deed registrar will print out the new title deed belonging to the purchaser from system and then deliver to the purchaser or authorized deed follower. Manager office will seal your new title deed of real estate and then will delivered to you.
Mortgaged Real Estate Transactions;
In mortgaged real estate transactions, all the procedure above mentioned will be carried out in the same way. In addition to these procedures, official credit documents and other deed documents, which are prepared by the bank (where credit will be used), should be delivered to title deed registration office so that credit process can be started. In sales on account, in addition, mortgage duty appears with deed duty. These are obtained from the cash points of authorized banks (Ziraat Bank, Halk Bank and Vakıf Bank).
In order to complete deed procedures in mortgaged sales, the lawyer or personnel authorized for the official documents by the bank, will examine deed documents and sign the relative sections as well as the purchaser and seller.
Redemption Procedures for a Property;
After all mortgage payments of a property that has been bought as mortgaged end completely, in order to give title deed registration office in regard to the relative Property, official mortgage RELEASE writing, which is prepared by the bank, should be received by special cargo from relative bank or in person in some cases, and then delivered to the title deed registration office. Along with this RELEASE writing prepared by relative bank, redemption will be carried out by new title deed registrar authorized by manager or assistant manager of title deed registration or the officer who made the deed transfer before.
Which procedures are applied for purchaser and seller who are not literates?
For purchasers and seller who are not literates, title deed transactions can be concluded by means of 2 witnesses of full legal age. To conclude deed transactions, these two witnesses, (purchaser and seller) and bank official, if any will sign the title deed documents.
Procedures that should be followed in purchasing, selling and required documents for citizens who were out of Turkish citizenship or Foreign National Citizens;
As for procedures, those who were out of Turkish citizenship are considered as foreign national citizens. In this case, procedures are as the following:
For title deed purchase or sales transactions, foreign national citizens signs the agreement that is prepared by the lawyers of Alanya Sönmez Real Estate and Construction company, translated in their own languages by official translators, printed on letterhead of our company and consists of two copies.
For foreign national citizens, deed transactions should be carried out;
After April of 2011, in purchase of real estate, for a residence that is intended to buy, if a citizen of any nation obtains deed purchase license from Ege Army Commandership allied to Turkish Republic Armed Forces Command, he/she can make application to get deed at the same day. For residences, if the case is total opposite, in other words before April of 2011 or a foreign will get deed for the first time; he gets “same as the original” approval from title deed registration with the original and copy of Passport at first. Then, documents are prepared to get deed purchase license from Ege Army Commandership allied to Turkish Republic Armed Forces Command. The title deed registration office is applied with these documents, passport photocopy that is approved “same as the original” by title deed office, T.R. tax identification number, deed copy of the property you decided to buy, property declared value that is received from Municipality where the property you decide to buy is there, and map with 1/5000 scale showing the location of property. Title deed registration office sends your documents to Ege Army Commandership by official mail. It might take almost 2-3 months to receive deed purchase license from Ege Army Commandership with respect to these documents. At last, following to the permission writing from the Ege Army Commandership, title deed registration office starts the deed transfer procedures. These procedures are the same as the above-mentioned procedures applied for Turkish citizens. However, for foreign national citizens, a certified translator in their languages should be available during deed transfer. Foreign national citizens, who sign the documents along with certified translator, can obtain official deed of real estate in which their own names are written such as Turkish citizens.
